According to this article, the team of litigators working with Trump to sue the Big Tech may have handled high profile cases but they have no experience on constitutional law cases. The lawyers include John P. Coale and John Q. Kelly who are very experienced and practitioners. However, the kind of free speech being raised in the lawsuits are new to them. Legal scholars have argued that the lawsuit will not be successful saying that it’s not possible to restrain the Big Tech companies from limiting free speech. A constitutional scholar called Erwin Chemerinsky said that the lawsuits are frivolous because Facebook, Google and Twitter are private entitles and the First Amendment will not apply to them. Minow, a Harvard Law professor stated that Section 230 which Trump and his team wants invalidated, plays an important role in keeping the government out of debates over free speech. According to the authors, Big Tech have become the villains currently and they are being fought in the courts and also in Congress.
